Description of Service

ParaSight is a mobile application designed to help users report and browse sightings of unexplained phenomena on a shared map. The Service provides:

• Sighting reports with location, description, and photos
• A map and feed of sightings submitted by other users
• Search and filtering by category, place, and date
• Comments and reactions on other users' reports
• Reporting and blocking tools for content and accounts

User Accounts and Registration

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your account credentials secure and confidential
• Be responsible for all activities under your account

Age Requirements

You must be at least 13 years old to use this Service. Users between 13 and 18 years old must have parental consent before using the Service.

User Content and Data

Your Content

You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for providing and improving the Service.

You represent and warrant that you own or have the necessary rights to all User Content you submit.

Content Standards

All User Content must:

• Be accurate and truthful to the best of your knowledge
• Respect the privacy and rights of others
• Comply with applicable laws and regulations
• Not contain harmful, offensive, or inappropriate material
• Not infringe on intellectual property rights

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Sapid Labs and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content, software, products, or services obtained from the Service.

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Service. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

Disclaimers and Limitation of Liability

Service Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Sapid Labs expressly disclaims all warranties of any kind, whether express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement and security
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation

Limitation of Liability

In no event shall Sapid Labs, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages arising from any content posted by another user, or from any decision to travel to or investigate a reported location
• Any unauthorized access to or alteration of your data

Our total liability to you for all damages shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Sapid Labs and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third-party right
• Any claim that your User Content caused damage to a third party

Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion features within the app. Upon termination, your right to use the Service will cease immediately.

Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

Effect of Termination

Upon termination, all provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of the United States, without regard to conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

Severability and Waiver

Severability

If any provision of these Terms is deemed invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

Waiver

No waiver by Sapid Labs of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and Sapid Labs concerning the Service. These Terms supersede all prior or contemporaneous communications and proposals between you and us.
